Should there be move in/out fees?
Positively Palermo received this e-mail: "Penny, there should be a move in and move out fee. The dumpsters were overflowing with tossed out junk from move outs. The now bye bye renters on Breeze filled up the trash bins on my street (Sunburst) so is the landlord going to pay for any extra pick ups?" Miss Penny Lane says: Thanks for your concern.

How about fees for whining. The only people complaining about the dumpsters being full are the ones who use them more than they should be. Put your trash out when you are supposed to!
I agree with the previous post. Here, again, we have a view/perspective which seeks to perpetuate an artificial and divisive perception that renters are different from homeowners and should therefore be "penalized" with unlawful and unreasonable punishment fees. I would encourage the homeowners who continue to try to make renters scapegoats for all of Palermo's dysfunction, to clearly understand the rights and privileges of tenants in the state of California. Renters enjoy the same rights and privileges regarding trash disposal, as homeowners and no "fee" for real or imagined infractions by renters can legally be charged. Again, renters have property owners, these property owners pay HOA fees/dues, etc. Property owners may lease or rent their properties to whomever they wish. The HOA may encourage property owners who wish to rent/lease their properties, to do so legally, responsibly, and ethically (i.e., thoroughly screen applicants/tenants), but slapping fees on renters, just because they are renters is distasteful and smacks of discrimination based on status, which last time I checked, is unlawful in the state of California.
I agree with the original poster.....both dumpsters were overflowing with trash of what appears somebody who has moved out....it was disgusting and not manageable. It is perfectly legal to charge the homeowner a move-in/ out fee from the HOA only if damage has occurred.
Civil Code §1366.1. Excessive Fees Prohibited An association shall not impose or collect an assessment or fee that exceeds the amount necessary to defray the costs for which it is levied.
So if we were to be picky, then if a tenant fills a trash bin with junk requiring an additional pick-up then we could charge the homeowner with their tenants additional expense to the HOA. Reality is we cannot even get our pool to a correct temperature, so doubt if we are going to be able to do that.

I guess owners never move out or use the dumpsters. Give me a break. If someone overfills a trash dumpster, we should penalize them for it, but to single out renters and penalize them for renting here is B.S.
LOL - " discrimination based on status"? - moving inane out fees are completely legal because of the extra costs involved. And why aren't the landlords telling their tenants not to do this? Overflowing trash bins are not acceptable.
A move in or out fee would be assessed to the Owner who then can pay it and pass it on to a renter if he wants.
There are differences between owners and renters in general. That is just a fact. Specifically, all the parking problems on Sandy Point and Melody Lane are caused by renters, including renters who claim (whine?) about having to sign a 30 page lease of rules to live in the Enterprise units and then seem to ignore them.
Michael Heath has specific language in the rental agreements telling renters they will be charged if they dump excessive amounts into the dumpsters. Talk to him.
If the fee is for excessive/overuse of the dumpster, then it should be levied against ALL who do so, not just renters. This would include owners who sell, and buyers who buy. But who, may I ask is going to police the imposition of fee and monitor this activity? What shall be considered "excessive" or "overuse"? What will be fee charged be? If two renters move on the same day (not unlikely or improbable), which renter shall be assessed the fee? The proposed solution (a fee to renters), is worse the problem. Why doesn't the Bd of Directors work with the management company to determine if there might be a trash pick-up schedule that is conducive to the needs of Palermo? If an extra pick-up is needed on or about the first of every month, what is the cost? Discuss.
To 10:20, some good points about an extra pick up. What about another dumpster near the front of the complex?
Oh My God... this is why I did not visit this site for a long while, just thought I would check in today to see if negativity on this site has changed to discover it just has gotten worse. I am a renter by the way, and when I moved in here one thing that I loved was the harmony and the caring, friendliness of our beautiful little community. I was grateful to life for bringing me here and I must add I still am grateful, because it is a great little community I like to call paradise. Do some of you not have a life beyond negativity? do you realize the beautiful gift of life and how lucky we are to be living here at Palermo, be grateful look for the positive in your life, outside these walls and in the world there are folks who can only dream to live lives like ours.
Wake up my dear friends and neighbors life is short, enjoy it. Spending all this negative energy on disliking people because they are renters or owners, is pure discrimination. Some of us renters have had very successful lives and have been homeowners too, but with recent economical issues, many people have had to rethink and reinvent themselves to a more simple modest lifestyle. Do not judge us as bad people because we rent. Unfortunately some people ( owners or renters ) are not at times considerate of others. But we should not judge all based on a few. If there is an issue address it to the board or management company, but please let's stop attaching each other.

To 1:56, nice posting but keep in mind none of it excuses bad behavior like the trash bin situation. You can't really say we all should just sit around a camp fire and sing and ignore brutish behavior. I say it's not "negatively" and "complaining" but people caring about their community and surroundings. To often here, people try to call real concerns "whining" as a way to dismiss it and deflection attention away from the matter of concern. The people who using the "whining" line really really are justing attacking the the people who first posted but are acting as if they are so positive when they really are being negative.
It is not complaining to expect people to follow the rules such as not abusing the trash bins or not having valid registrations on the cars.

I notice that that apparently unregistered car that was parked on my street now haas moved to parking in a carport elsewhere here, and notice how they always back in so you can't see the back plate and registration.
If his car is not registered there might be a good reason for it and it could be as simple as with the completly outragus fees here in Ca he might be having a hard time coming up with the money. Yes, the rules say it needs to be registered and rules are rules. There is something else to consider. Human compasion, empathy and even just helping your neighbor. A little understanding can go a long way. Not to mention has anyine taken the time to go talk to him or her?
